Terms and Conditions

Please review these Terms and Conditions carefully. They govern your access to and use of PulsarSense smart devices, mobile applications, web dashboards, and industrial telemetry infrastructure.

1. Acceptance of Terms

By registering, downloading, accessing, or using the PulsarSense website, mobile applications (including PulsarSense Smart), industrial client services, or connected IoT hardware, you agree to be bound by these Terms and Conditions ('Terms').

If you are using our services on behalf of an entity or business organization, you represent and warrant that you possess the requisite authority to bind that entity to these Terms. If you do not agree, you must cease accessing all PulsarSense software, cloud services, and connected hardware.

2. Description of Services

PulsarSense provides an integrated smart IoT ecosystem comprising: (a) cloud telemetry dashboards, (b) native Android mobile applications, (c) edge Windows desktop collectors (PulsarSenseCollector / OPC UA gateways), and (d) specialized firmware and embedded hardware controllers (such as Pulsar Sense Guard, Solar Base, and Solar Pro gateways).

Services include real-time solar inverter telemetry, automated relay switching, GSM trigger handling, energy flow analytics, multi-tenant site administration, and alert dispatching.

We reserve the right to modify, update, or discontinue features of our cloud platform or software with reasonable notice to ensure ongoing platform security and performance.

3. Hardware Integration & Electrical Safety Notice

CRITICAL SAFETY WARNING: Connecting edge IoT devices to high-voltage solar inverters, lithium battery banks, electrical distribution panels, industrial contactors, or heavy machinery involves severe risks of electrical shock, fire, equipment damage, or personal injury.

Professional Installation Required: Physical wiring, Modbus RS485 termination, and relay connections must be performed exclusively by qualified, licensed electricians and certified technicians in compliance with all applicable local, national, and international electrical codes (e.g., NEC, IEC standards).

No Safety Interlock Substitute: PulsarSense hardware and software are designed solely for telemetry monitoring and automated operational convenience. PulsarSense products must NEVER be used as a primary safety shutdown mechanism, emergency stop (E-STOP), or in life-critical industrial fail-safe loops.

4. Account Registration & Tenant Security

You must provide accurate, current, and complete information during registration and maintain the confidentiality of your login credentials and hardware activation tokens.

You are solely responsible for all activities occurring under your account and linked tenant organizations. You must promptly notify support@pulsarsense.com if you suspect unauthorized access or compromise of your credentials or activation codes.

PulsarSense implements multi-tenant isolation; attempting to query, intercept, or access telemetry belonging to another tenant is strictly prohibited and constitutes grounds for immediate permanent termination and legal action.

5. Software License & Acceptable Use

License Grant: Subject to your compliance with these Terms, PulsarSense grants you a limited, non-exclusive, non-transferable, revocable license to access our cloud dashboards and install our client and mobile applications on your authorized devices.

Prohibited Conduct: You agree not to: (a) reverse engineer, decompile, or disassemble our compiled binaries or proprietary firmware; (b) launch denial-of-service (DoS) attacks or flood API endpoints with unauthorized high-frequency requests; (c) bypass device licensing mechanisms or panel match verification; or (d) resell or sublicense platform access without express written permission from PulsarSense.

6. Telemetry Data & Offline Buffering

Data Ownership: You retain ownership of all telemetry, production records, and machine data generated by your equipment.

Data Processing License: You grant PulsarSense a worldwide, royalty-free license to store, process, display, and analyze your telemetry solely to deliver and optimize the service for your organization.

Offline Resilience: PulsarSense controllers utilize local buffering to preserve telemetry during network disconnects. While buffered data synchronizes upon reconnection, PulsarSense is not liable for delayed alerts or data loss caused by extended local power loss, hardware destruction, or ISP failures.

7. Warranty Disclaimer & Limitation of Liability

AS-IS Provision: To the maximum extent permitted by applicable law, the services and software are provided 'AS IS' and 'AS AVAILABLE', without warranties of any kind, whether express, implied, statutory, or otherwise.

Limitation of Damages: Under no circumstances shall PulsarSense, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, energy yield losses, equipment damage, production downtime, or data corruption—arising out of or related to your use of or inability to use the platform.

Cap on Liability: In all cases, our aggregate liability for any claims under these Terms shall be limited to the total fees paid by you to PulsarSense during the six (6) months preceding the event giving rise to liability.

8. Termination & Suspension

We reserve the right to suspend or terminate your account and platform access if: (a) you violate these Terms, (b) your subscription lapses, or (c) your connected hardware causes network instability or security threats to the platform.

You may terminate your account at any time by requesting deletion through our account deletion portal or by contacting support@pulsarsense.com.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law principles. Any dispute or claim arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Islamabad, Pakistan.
